SMS Text Messaging Program Terms

Program Description

Program Name: DV Props Tenant Notifications

Diamond V Properties offers an SMS text messaging program to provide tenants and applicants with important notifications including:

• Rent payment reminders and late payment notifications
• Property maintenance updates and announcements
• Lease renewal reminders
• Emergency property notifications
• Application status updates

How to Opt-In

You can consent to receive SMS messages from DV Props in the following ways:

• Online Application: By checking the SMS consent checkbox on our rental application form at dvprops.net/apply
• Lease Agreement: By signing your lease agreement which includes SMS consent language
• Written Consent: By providing written consent via email or paper form

Consent to receive SMS messages is not a condition of purchasing any goods or services from DV Props.

Message Frequency

You may receive up to 4-6 messages per month. Message frequency may vary based on your account activity and property-related events.

Message and Data Rates

Message and data rates may apply based on your mobile carrier's plan. Please contact your mobile carrier for details about your specific plan and any charges that may apply.

SMS Provider

We use Twilio as our SMS service provider. Messages are sent from phone number +1 (855) 395-2421 (toll-free) or +1 (412) 754-7123 (local).

How to Get Help

For help with SMS messages, you can:

• Reply HELP to any text message from DV Props

When you reply HELP, you will receive a message with support contact information.

How to Opt-Out

You can opt-out of receiving SMS messages at any time by:

• Reply STOP to any text message from DV Props
• Emailing us at [email protected] with your opt-out request
• Calling us at (208) 358-7865

When you reply STOP, you will receive a confirmation message that you have been unsubscribed. You will no longer receive SMS messages from DV Props unless you opt-in again.

Important: Opting out of SMS communications does not affect your lease obligations or our ability to contact you through other means (email, phone calls, postal mail, or in-person).

Supported Carriers

Our SMS program supports all major U.S. carriers including AT&T, T-Mobile, Verizon, Sprint, and many regional carriers. If you experience issues receiving messages, please contact your carrier or reach out to us directly.

Rental Application Terms

By submitting a rental application through our website or in person, you:

• Authorize DV Props to verify all information provided
• Authorize credit checks, criminal background checks, and employment verification
• Authorize contact with references and previous landlords
• Certify that all information provided is true and accurate

Application fees are non-refundable. False information may result in denial of your application or termination of tenancy if discovered after move-in.

Payment Terms

Rent payments can be made through our online payment portal powered by Stripe. By using our payment services, you agree to:

• Provide accurate payment information
• Authorize DV Props to process payments on your behalf
• Pay rent by the due date specified in your lease agreement
• Be responsible for any late fees as outlined in your lease

Payment processing is subject to Stripe's terms of service. We do not store your full credit card information on our servers.

Website Use

You agree to use our website only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable laws or regulations
• Impersonate any person or entity
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the website
• Submit false or misleading information

Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of Diamond V Properties or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written permission.

Limitation of Liability

To the fullest extent permitted by law, Diamond V Properties shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website. Our total liability shall not exceed the amount of rent paid by you in the preceding month.

Governing Law

These Terms and Conditions are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Pennsylvania.

Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website with a new "Last Updated" date. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
